THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF INFORMATION TECHNOLOGY ACT, 2000 AND RULES THEREUNDER AS APPLICABLE AND THE PROVISIONS PERTAINING TO ELECTRONIC RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000


A General Terms

These rules apply when you use the EesyRide App or website,  The term "you" or "User" refers to anyone who uses the app or site. The ride services are provided by drivers, who use the app to offer rides.

Please read these rules carefully before using the app or signing up. By using the app, you agree to follow these rules. If you don’t agree with them, do not use the app.

These rules replace any previous agreements you may have had with us. By using the app, you accept all the rules and the privacy policy, including any changes made by the company in the future.

1.Platform

EesyRide has a technology platform (called a "SAAS Platform") that helps connect you with drivers  who offer rides in autos (three-wheelers) or cabs (four-wheelers). These rides are provided by the drivers themselves, and the terms of the ride are agreed between you and the driver.

By accepting these rules, you can use the platform to find available drivers based on your pickup and drop-off locations and agree on the ride fare with the driver.

2.Covenant

When you use the SAAS Platform, you promise the following:

  • You are at least 18 years old to register and create an account.
  • There are no legal or official reasons stopping you from using the platform.
  • You will only use the platform for allowed purposes and follow the laws.

3.Registration

By using the SAAS Platform, you allow EesyRide (or third parties on our behalf) to collect information about you to verify your identity, following our Privacy Policy. Make sure to read the Privacy Policy to understand how we handle your information.

When you provide your information to EesyRide, you agree that it is true, accurate, and up to date.

To register and create an account, you must provide accurate information. You are responsible for keeping your login details (username, password, etc.) private. EesyRide is not responsible if someone else uses your account, with or without your permission.

You agree to choose secure passwords and protect your account information from unauthorized access. If you believe someone else has access to your login details or account, you need to notify us immediately.

We may ask for more information or documents to verify your identity, email address, or payment details. If we can’t verify your information, we may limit or suspend your access to the platform.

You are responsible for providing correct contact and other details needed to use the platform. We won’t verify the information you provide, so be careful to avoid errors.

Your account is personal and can’t be transferred or sold to someone else. The platform is for people over 18 only, and you can’t let others use your account.

You are responsible for all activities that happen under your account, and EesyRide is not liable for any security breaches or unauthorized use.


4. Access to SAAS Platform

Once you’ve created your account, you can find available drivers  on the EesyRide App who are ready to give you a ride from your pick-up location to your drop-off location.

All payments, refunds, and cancellations are between you and the Driver, and EesyRide has no part in these transactions.

You can offer a price to the Driver for the ride based on the distance and route you need. The Driver can either accept or reject the price you offer.

Once you both agree on the price, the Driver will take you on your ride, and EesyRide won’t be involved in the transportation.

EesyRide may show an estimated fare based on typical market rates to help guide you when offering a price, but this is just an estimate, and EesyRide doesn’t guarantee the accuracy of the price.

EesyRide also has the right to change or stop access to the platform at any time.


5.Payment 

You’ll need to pay the fare for the ride directly to the Driver.

The Driver can charge extra fees, including taxes, for the ride services. Any payments you owe to the Driver, or that the Driver owes to you, are part of the agreement between you and the Driver, and should be settled between you two outside the EesyRide app. EesyRide isn’t responsible for any of these payments.

The Driver may give you an invoice for the ride, but EesyRide will not issue or help create any invoice for the ride.

These terms may be affected by taxes, fees, or other charges that may apply now or in the future.

6.Conduct

You must use the platform legally and responsibly, without doing anything that could harm EesyRide  reputation.

You should not use the platform to cause trouble for EesyRide or anyone else. You also cannot misuse it or try to cheat EesyRide or others. This includes actions like giving false information, creating fake accounts, messing with the platform's settings to stop it from working properly, abusing promotions, or breaking the law in any way.

By using the platform, you agree to the following:

  • You will only use the platform for personal use, not to sell it to others.
  • You will not use the platform for illegal activities or fraud.
  • You won’t interfere with how the platform works or use harmful tools like viruses to damage it.
  • You won’t overload the platform’s system by sending too many requests or "spam."
  • You won’t copy, distribute, or sell the platform without permission.
  • You won’t modify the platform or try to create a similar product.
  • You won’t use any device that is not allowed to access the platform.
  • If you create multiple accounts, EesyRide can delete them.

Also, you must not upload or share harmful content, such as:

  • Content that belongs to someone else without permission.
  • Offensive, abusive, or unlawful material.
  • False information or misleading content.
  • Anything that harms children or violates laws.
  • Content that impersonates someone else or promotes illegal activities.

If you don’t follow these rules, EesyRide has the right to immediately suspend your access to the platform.


7.Notification

You agree that EesyRide (or its affiliates and third parties) may contact you in case of an emergency related to safety or security. This communication could be via push notifications, phone calls, WhatsApp, email, or other methods.

Any electronic messages sent to you (like emails, SMS, or WhatsApp messages) will be considered received within 24 hours. If sent by postal mail, we will assume you received it 3 business days after it was sent.

If you are a registered user and have provided your contact details, you give EesyRide permission to reach out to you in case of a safety or security situation. This could be through calls, texts, or emails using the contact information you provided, including:

  • Your mobile or landline number
  • Your email address linked to your account
  • Automated dialing systems, pre-recorded or voice messages

EesyRide is not responsible for issues like missed, delayed, or unclear communications related to ride services provided by the Driver.


8.Disclaimer

The company does not guarantee that the platform will always work reliably, on time, or without errors. It also doesn’t promise that the platform will meet your needs, that data will be accurate, or that any issues will be fixed. The platform may also contain viruses or harmful components. The platform is provided “as is,” meaning you use it at your own risk.

The company is not responsible for the behavior or actions of the Drivers, the quality of their vehicles, or the ride services they provide. The agreement for ride services, including payment, is directly between you and the Driver. EesyRide only helps connect you with the Drivers, but does not provide the actual ride services.

The company tries to keep the platform up-to-date and functioning properly, but it doesn’t guarantee that there won’t be errors, viruses, or interruptions. The company is not liable for any losses or damages that occur due to issues with the platform, such as delays or failures in service, problems with electronic communications, or viruses.

The platform’s performance may sometimes be affected by things beyond EesyRide’s control, such as equipment failures, software issues, extreme weather, power outages, or government actions.


8.Intellectual Property Rights

The company owns all rights to the platform, including its design, content (text, images, video, etc.), and any intellectual property (such as patents, copyrights, trademarks, and trade secrets) associated with it. This includes all related logos and marks, which are protected by law. Unauthorized use or reproduction of these marks is not allowed.

The company grants you a limited, revocable license to download and use the platform on a single device for your personal use, as long as you comply with the terms of use.

User Data:
The information you input into the platform (referred to as "User Information") belongs to you. However, you give EesyRide a limited, non-exclusive license to use that information to operate and improve the platform. EesyRide can also use the information in an aggregated, anonymous way to create statistical reports or data for their own purposes. You are responsible for ensuring the information you provide is accurate and legal. EesyRide will handle your data according to these terms and the privacy policy.

Aggregated Statistics:
EesyRide can monitor and collect data on your use of the platform and combine it with data from other users to create aggregated, anonymous statistics. These statistics belong to EesyRide, and they may use and share these statistics publicly for research, service improvement, and marketing purposes.


9.Third Party Link

While using the SAAS platform, you might interact with or purchase products and services from third-party Driver, advertisers, or sponsors through links provided on the platform. Once you click on these links, you will leave the platform, and these websites are beyond the company’s control. Therefore, you access these third-party websites at your own risk.

These external websites may use their own cookies, collect data, or ask for personal information. It’s important to review their terms of use or privacy policies before using them.


10.Termination

The company has the right to immediately terminate your access to the SAAS Platform if you:

  • Violate any of these terms,
  • Misuse the platform or service in any way, or
  • If there is a suspicion that your account is being used fraudulently.

Additionally, the company can terminate your access at any time, without providing a reason, and without notice. After termination, the company will inform you as per these terms.

If you violate these terms, the privacy policy, or applicable laws, the company may also choose to take legal action against you, especially if your actions are deemed fraudulent, harmful to the company's interests, or damaging to other users or third parties.

Lastly, if the company doesn't enforce any part of these terms right away, it doesn’t mean they are waiving their rights to do so later.


11.Limitation of liability

You agree to defend, indemnify, and hold the Company, its affiliates, officers, directors, agents, and employees harmless from any claims, losses, liabilities, damages, expenses, and costs (including legal fees) that arise from:

  • Your use or misuse of the SAAS Platform,
  • Your breach or violation of these Terms, and
  • Any third-party claims resulting from your use of the SAAS Platform.

EesyRide reserves the right to handle the defense of any claim at your expense, including the right to settle the matter. You agree to cooperate with EesyRide in these proceedings. You may hire separate counsel at your own cost to advise you, but EesyRide maintains the right to control the defense and settlement.

EesyRide is not responsible for assessing or monitoring the suitability or legality of any Drivers. You release EesyRide from any liability or damages related to the Driver, their actions, or disputes between you and the Driver. EesyRide will not mediate or handle payments between you and the Driver, and all responsibility for decisions related to services offered through the Driver rests solely with you.

EesyRide will not be liable for any indirect, punitive, incidental, special, or consequential damages. In no event will EesyRide's total liability under these Terms exceed INR 100.


12.Governing Law, Jurisdictions and Dispute Resolution

These Terms will be governed by and interpreted in accordance with the laws of the Republic of India.

Subject to Clause XIII.3, both parties agree to submit to the exclusive jurisdiction of the courts of Bangalore, India, for any legal matters.

Any disputes arising out of or related to these Terms will first be attempted to be resolved amicably within 15 days from the initiation of the dispute. If an amicable resolution is not reached within this period, the parties will proceed with arbitration under the Arbitration and Conciliation Act, 1996.

The arbitration will be conducted by a tribunal consisting of one arbitrator, mutually appointed by both parties. The proceedings will be conducted in English, and the seat of arbitration will be Bangalore, India.

The award rendered by the arbitral tribunal will be final and binding on the parties.


13.Assignment

You may not assign your rights or obligations under these Terms without obtaining prior written approval from the Company. However, EesyRide reserves the right to freely assign its rights and obligations under these Terms without the need for prior notice to or consent from the User.


14.Severability

If any provision or part of a provision of these Terms is determined to be invalid, unenforceable, or prohibited by the applicable laws of the Republic of India, that provision or part will be severed from these Terms. It will be considered divisible, and the remainder of these Terms will remain valid, binding, and effective as though the invalid provision or part had not been included.


15.Change to terms

EesyRide has the right to change these Terms periodically. If any material changes are made, EesyRide will make reasonable efforts to inform you. However, it is your responsibility to regularly review the Terms posted on the Platform to check for any changes. The updated version of these Terms will replace the current version and will take effect immediately upon being posted on the Platform. By continuing to use the Platform after the updated Terms are posted or after being notified of the changes, you are deemed to accept the modified Terms.


16.Notice

The Company may provide notices to you through various means, including posting a general notice on the Platform, sending an electronic mail to the email address associated with your account, or mailing a written communication to the address you have provided to the Company.


17.Account Deletion and Data Retention

When you delete your account, we permanently remove your personal information from our systems and revoke access to your account. However, in certain cases, we may retain specific data (such as ride history, driver interactions, and trip details) for a limited time as required for legal, safety, fraud-prevention, or operational purposes — for example, to allow drivers to access completed ride information or to resolve disputes. This data is handled in accordance with our privacy and data retention policies and is no longer associated with your active user profile.


18. Grievance Redressal

For assistance, you can reach EesyRide Customer Care Support@Eesyride.com Alternatively, you can use the chat feature in the EesyRide App to contact an associate, or reach out through the 24/7 call support for any technical issues or emergency safety and security situations related to the SAAS Platform.

Please note that Customer Care will not handle any issues related to the ride services provided by the Drivers, including ride fare, collection of ride fare, or service quality.
